Subaru Settles Lawsuit Over EyeSight Driver-Assist System

A recent settlement has brought an end to a four-year class-action lawsuit against Subaru, centering on alleged malfunctions within its advanced EyeSight driver-assistance system. The legal challenge, initiated in 2021 by a group of nine plaintiffs, contended that the EyeSight system, integrated into numerous Subaru models from 2013 to 2024, did not consistently perform as intended, leading to unpredictable vehicle behavior.

The core of the plaintiffs' claims revolved around the EyeSight system's pre-collision braking, rear automated braking, and lane-keeping assist features. Reports indicated instances where the brakes would engage unexpectedly or fail to activate when required, alongside erratic steering wheel movements. Despite these allegations, Subaru consistently maintained that its vehicles were safe and denied any wrongdoing throughout the legal proceedings. Notably, no official recall or investigation regarding these issues was found on the National Highway Traffic Safety Administration's recalls website.

As part of the resolution, the named plaintiffs received $5,000 each, while the legal representation was awarded over $2.4 million. Beyond the monetary compensation, Subaru committed to implementing an extended warranty specifically for EyeSight system repairs and agreed to reimburse certain repair costs. However, a significant limitation of this extended coverage is its duration: repairs are only covered for 48 months or 48,000 miles from the vehicle's initial service date. This stipulation effectively means that for a substantial portion of the older vehicles involved in the lawsuit, this 'extended' warranty had already lapsed by the time the settlement was finalized, with any remaining coverage periods now also expired.
